All prices on this site are quoted in Australian dollars. The price, if affected, will include GST.

Orders

Any order placed by you is in effect a commitment by you to purchase a product for the price (including the delivery and other charges) specified in this web site. Top Photos may accept or reject your offer for any reason, including, the unavailability of any product, an error in the price or the product description shown on this web site, or an error in your order. Your contract with Top Photos will only come into existence when you have fully paid for your order and Top Photos notifies you that it has accepted your order and your receipt has been confirmed. Prices of products, services and delivery and other related charges as displayed are current at the time of issue, but may change at any time and are subject to availability. Similarly the availability of products and services may change from time to time.

Loss or Damage in Transit

Top Photos is not responsible to the purchaser or any person claiming through the purchaser for any loss or damage to goods or products caused by any event of any kind by any person, whether or not Top Photos is legally responsible for the person who caused or contributed to that loss.

The copyright in the photographs is owned by and retained by Andrew McGaughey at all times throughout the world. The customer agrees that Andrew McGaughey is the sole author of the photographs.

Electronic Communications

No alteration or manipulation of the image may be made without the permission of Andrew McGaughey

Cancellation and postponements

Once Andrew McGaughey has been commissioned, the client is responsible for payment of all expenses incurred up to the time of cancellation and Andrew McGaughey will be entitled to charge a fee for cancellation or postponement at his discretion.

Right to a credit

Andrew McGaughey’s name will be printed in reasonable proximity to all published reproductions of the photographs unless agreed otherwise prior to the work commencing.
